District Attorney Hoovler: 20 Year Sentence for Sexual Assault of Two Children

Orange County

Kevin Cholula Previously Pled Guilty to Course of Sexual Conduct Against a Child in the First Degree

Orange County District Attorney David M. Hoovler announced that Kevin Cholula, age 31, of New Windsor, was sentenced in Orange County Court to twenty (20) years in prison, to be followed by ten (10) years of post-release supervision relative to his previous guilty plea to two (2) counts of Course of Sexual Conduct Against a Child in the First Degree.  As part of the sentence, Cholula will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA).  At the plea proceedings, Cholula admitted that between July, 2020 and October, 2023 he engaged in two or more acts of sexual conduct, which included at least one act of sexual intercourse, oral sexual conduct, anal sexual conduct or aggravated sexual contact with two children less than eleven years old.

District Attorney Hoovler thanked the Town of New Windsor Police Department for their investigation which led to the arrest of the defendant.

“There is no punishment short of a lengthy prison sentence that is acceptable for the admitted conduct of this defendant,” said District Attorney David M. Hoovler. “Our community will be safer while this offender spends the next two decades in prison.  Cases such as this one and any sexual crimes against children are particularly challenging to investigate and prosecute.  We are only able to see justice is done because of the dedicated work of the police and prosecutors.  Simply put, we will never cease in our pursuit of sexual predators.  We continue to provide support for victims of sexual assault and will hold offenders accountable for their actions.”

The case is being prosecuted by Senior Assistant District Attorney Julie Mohl.

A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
